Unless you can actually prove that these things were in the car when they got there to tow it – you are screwed!
However if you do have this proof immediately hire an attorney and take them for all you can get out of them including your Attorney fees and Court costs!
my experience….dont leave a thing in the car when it is towed….a tow truck driver was towing my car…i caught him right before he hooked it up….and i made him wait till i took my subs…..and amp….he didnt like that too much,im sure he knew they were in there then was not happy that he couldnt have them for himself…….once it leaves your possesion you can just wave bye bye….
They are not responsible for what is left in the car. So if you left anything in the car go get it asap because i had an accident last year and i lost a lot of things.
I would call the police department that handled your case and ask them for help. You may have found a crooked towing company. Technically the tow truck company should not have went through and inventoried anything unless it was released from the crime/accident scene by the police department. Your vehicle was a piece of evidence. Hope this helps.
Most tow yards do not inventory items. They most likely did not go digging for the items you are refering to or they could have been thrown from the vehicle in the accident or stolen at some point in time. Most tow yards do all they can to prevent theft but most likely will not reimburse you for any items lost.
They should however let you get your items out of the vehicle if you bring proof of ownership.
